Six years on from passing the Commons Act, the vast majority of Part 1 is not yet in force. This means that in most of England the the commons registers held by county councils cannot be updated. FCL thinks this is a nonsense as it is imposing costs on commoners and perpetuating uncertainties among commoners and the owners of common land. Richard Benyon, Parliamentary Under-Secretary for Natural Environment and Fisheries, has responded to our concern. He says that Defra has made a commitment to fully commence Part 1 of the Act throughout England. However, the timetable for doing so has yet to be determined. An announcement will be made in the next few weeks.
